Terms of Service
IMPORTANT LEGAL NOTICE: PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING THE FOREVLE PLATFORM. THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER (FOR USERS OUTSIDE THE EUROPEAN ECONOMIC AREA) THAT AFFECT YOUR LEGAL RIGHTS.
1. INTRODUCTION AND ACCEPTANCE
1.1 Parties and Services
Welcome to Forevle. These Terms of Service ("Terms," "Agreement") constitute a legally binding contract between you ("User," "you," "your") and Forevle B.V., a private limited liability company organized under the laws of the Netherlands with its registered office in Amsterdam, together with its affiliated entities (collectively, "Forevle," "Company," "we," "us," "our").
These Terms govern your access to and use of: - The Forevle website located at forevle.com and all associated subdomains (the "Website"); - The Forevle mobile applications for iOS and Android (the "App"); - The Forevle interactive story creation and gameplay platform (the "Platform"); - All content, features, tools, services, and functionality offered through the foregoing (collectively, the "Services").
1.2 Acceptance of Terms
BY ACCESSING, BROWSING, OR USING THE SERVICES, OR BY CLICKING "I ACCEPT," "I AGREE," OR SIMILAR BUTTON OR CHECKBOX, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY (INCORPORATED HEREIN BY REFERENCE). IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICES.
If you are accessing or using the Services on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms. In such case, "you" and "your" shall refer to both you individually and such entity.
1.3 Changes to Terms
We reserve the right to modify, amend, or update these Terms at any time in our sole discretion. Material changes will become effective thirty (30) days after we post the updated Terms on the Services or notify you by email to the address associated with your Account, whichever occurs first. Non-material changes are effective immediately upon posting. Your continued use of the Services after any modification constitutes your acceptance of the modified Terms.
For users in the European Economic Area ("EEA"), United Kingdom ("UK"), or Switzerland (collectively, "European Users"), we will provide at least thirty (30) days' notice of any material changes that negatively affect your rights, and such changes will not apply retroactively.
1.4 Additional Terms
Certain features, promotions, or services may be subject to additional terms, guidelines, or rules ("Additional Terms"), which will be posted in connection with such features. All Additional Terms are incorporated by reference into these Terms. In the event of a conflict between these Terms and any Additional Terms, the Additional Terms shall control with respect to the specific feature, promotion, or service to which they apply.
2. DEFINITIONS
For purposes of these Terms, the following definitions apply:

"Account" means a registered user account on the Platform.

"AI Systems" means Forevle's proprietary artificial intelligence systems, including but not limited to the Director AI, Artist AI, Logic AI, and any other machine learning models, algorithms, or automated systems used to generate, process, or curate content on the Platform.

"Content" means any and all text, graphics, images, audio, video, data, information, or other materials.

"Creator" means a User who creates, publishes, or distributes User Content on the Platform.

"Credits" means the virtual credits or currency used on the Platform to access certain features or content.

"Forevle Parties" means Forevle B.V., its affiliated entities, and their respective officers, directors, employees, agents, representatives, licensors, and service providers.

"Generated Content" means any Content created, in whole or in part, by the AI Systems, including but not limited to AI-generated visuals, dialogue, sound effects, voice acting, and interactive story elements. Generated Content is a form of User Content created with AI assistance.

"Interactive Story" or "Story" means an interactive fiction experience created on the Platform, consisting of User Content, Generated Content, or a combination thereof.

"Minor" means any person under eighteen (18) years of age, or under the age of majority in their jurisdiction of residence, whichever is higher.

"Player" means a User who plays, interacts with, or consumes Interactive Stories on the Platform.

"Subscription" means a recurring paid plan providing access to premium features.

"User Content" means any Content that Users submit, upload, post, transmit, or otherwise make available through the Services, including story text, character descriptions, plot outlines, and any inputs provided to the AI Systems.
3. ELIGIBILITY AND ACCOUNT REGISTRATION
3.1 Age Requirements
You must be at least eighteen (18) years old to create an Account and use the Services.
By creating an Account, you represent and warrant that you are at least eighteen (18) years of age. If you are a parent or legal guardian, you may permit a minor under your supervision to access the Services through your Account, provided that:
(a) You accept full responsibility for the minor's use of the Services;
(b) You supervise the minor's use of the Services;
(c) You acknowledge that the Platform contains user-generated and AI-generated content with varying content ratings, and while we strive to provide accurate content warnings and age ratings on Stories, we cannot guarantee 100% accuracy of such ratings;
(d) You assume all risks associated with the minor's access to content on the Platform;
(e) You agree to these Terms on behalf of the minor.
Forevle does not knowingly collect personal information from minors. All Account holders must be eighteen (18) years of age or older.
3.2 Account Creation
To access certain features of the Services, you must create an Account. When creating an Account, you agree to:
(a) Provide accurate, current, and complete information;
(b) Maintain and promptly update your Account information;
(c) Maintain the security and confidentiality of your login credentials;
(d) Accept all responsibility for all activity that occurs under your Account;
(e) Immediately notify us of any unauthorized use of your Account.
You may not: - Create more than one Account; - Share your Account credentials with any third party; - Use another person's Account without authorization; - Create an Account using false or misleading information; - Create an Account if you have been previously banned or terminated.
3.3 Account Security
You are solely responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. Forevle shall not be liable for any loss or damage arising from your failure to protect your Account credentials. We reserve the right to suspend or terminate any Account that we reasonably believe has been compromised.
4. THE FOREVLE PLATFORM
4.1 Description of Services
Forevle is an interactive fiction platform that enables Creators to write stories and transform them into playable, interactive experiences using our proprietary AI technology. The Platform offers:
(a) Story Creation Tools: A no-code editor allowing Creators to write narrative content that is processed by our AI Systems to generate interactive experiences;
(b) AI Generation: Our proprietary AI systems that generate visuals, dialogue, sound, and interactive story elements;
(c) Discovery and Curation: Systems that promote high-quality, high-retention Stories;
(d) Gameplay Experience: An interactive story-playing interface for Players;
(e) Social Features: Rating, commenting, sharing, and community features.
4.2 Nature of AI-Generated Content
You acknowledge and agree that:
(a) The AI Systems generate Content probabilistically based on inputs, training data, and algorithms, and the output may be unpredictable, unexpected, or inconsistent;
(b) Generated Content may not be accurate, complete, reliable, or suitable for any particular purpose;
(c) Generated Content may contain errors, inaccuracies, or content that some Users may find objectionable;
(d) The same or similar inputs may produce different outputs at different times;
(e) Forevle does not guarantee any particular outcome, quality level, or characteristic of Generated Content;
(f) AI-generated visual, audio, and narrative elements are synthetic and do not depict real people, places, or events unless expressly created from User-provided content.
4.3 Platform Availability
We strive to keep the Services available and operational. However, the Services are provided "as is" and "as available." We do not guarantee that:
(a) The Services will be uninterrupted, timely, secure, or error-free;
(b) The results obtained from the Services will be accurate or reliable;
(c) The quality of any content, products, or services will meet your expectations;
(d) Any errors in the Services will be corrected.
We reserve the right to modify, suspend, or discontinue all or any portion of the Services at any time, with or without notice. For paid subscribers in the EEA, we will provide reasonable advance notice of any material changes to the Services that negatively affect your subscription.
4.4 Service Modifications
We may update, modify, enhance, or discontinue any aspect of the Services at any time, including features, functionality, content, user interfaces, and technical requirements. You acknowledge that the Services are dynamic and may change over time, and you agree not to rely on the continued availability of any particular feature or functionality.
5. USER CONTENT AND CREATOR RIGHTS
5.1 Your Original Creative Work
You own your original creative work. This includes:
- •Story text, narrative, and dialogue you write
- •Characters, worlds, and concepts you create
- •Plot outlines, descriptions, and creative direction you provide
- •Any other content you create independently and submit to the Platform
This is your intellectual property. You can publish it elsewhere, adapt it, sell it, or do anything else you would do with work you own. Using Forevle does not transfer ownership of your original creative work to us.
5.2 License Grant to Forevle
To operate the Platform, you grant Forevle a license to use your User Content as described below. This license allows us to run the service—it does not transfer ownership of your work.
By submitting User Content, you grant Forevle and its affiliates a worldwide, non-exclusive, royalty-free, sublicensable license to:
(a) Host, store, cache, copy, reproduce, and back up the User Content;
(b) Display, perform, publish, distribute, and transmit the User Content to other Users through the Services;
(c) Modify, adapt, translate, create derivative works from, excerpt, and reformat the User Content solely as necessary for the purpose of operating, providing, and improving the Services (for example, formatting for different devices or creating thumbnails);
(d) Analyze the User Content for content moderation, safety, policy enforcement, and aggregated analytics purposes;
(e) Feature, showcase, or promote the User Content in connection with marketing or demonstrating the Services, with attribution to you where reasonably practicable;
(f) Sublicense the foregoing rights to service providers and partners solely as necessary to operate and provide the Services.
This license does not include the right to sell your User Content to third parties or to use your User Content for AI model training, except as described in Section 6.7 (AI Training Opt-In).
This license continues for as long as your User Content remains on the Services. If you delete your User Content or your Account, this license terminates, except that: (a) we may retain copies for a reasonable period for backup, archival, or legal compliance purposes; (b) content that has been shared, cached, or incorporated into other Users' experiences may persist; and (c) we may retain anonymized or aggregated data derived from your User Content.
5.3 License Grant to Other Users
By publishing User Content publicly on the Platform (e.g., publishing a Story), you also grant other Users a non-exclusive license to access, view, play, interact with, and share such User Content through the functionality provided by the Services.
5.4 User Content Representations and Warranties
By submitting User Content, you represent and warrant that:
(a) You are the creator and owner of the User Content, or have obtained all necessary rights, licenses, consents, and permissions to submit it and grant the licenses herein;
(b) The User Content does not and will not infringe, misappropriate, or violate any third party's intellectual property rights, rights of publicity, rights of privacy, or any other proprietary or legal rights;
(c) The User Content does not and will not violate any applicable law, regulation, or these Terms;
(d) The User Content does not contain any false, misleading, defamatory, or fraudulent statements;
(e) You have obtained all necessary consents from any individuals depicted, identified, or whose personal information is included in the User Content;
(f) You are solely responsible for your User Content and the consequences of posting or publishing it.
5.5 No Obligation to Monitor; Right to Remove
We are under no obligation to monitor, review, or edit User Content, but we reserve the right (but not the obligation) to do so at any time, for any reason or no reason, in our sole discretion. We may remove, disable access to, or modify any User Content at any time, for any reason or no reason, including if we determine that the User Content violates these Terms, our Community Guidelines, or applicable law.
5.6 Feedback
If you provide us with feedback, suggestions, ideas, comments, or other input regarding the Services ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable, and transferable license to use, reproduce, modify, create derivative works from, distribute, publicly display, and otherwise exploit the Feedback for any purpose, without any obligation or compensation to you.
This is standard practice for product feedback and is necessary for us to freely implement improvements you suggest. This provision applies only to Feedback about the Services, not to your User Content or Generated Content, which are governed by Sections 5.2 and 6.2.
6. AI-GENERATED CONTENT
6.1 Generated Content
"Generated Content" means content created by our AI Systems based on your inputs, including:
- •AI-generated images, character portraits, and visual scenes
- •AI-generated audio, sound effects, and voice synthesis
- •AI-generated interactive elements and game mechanics
- •Other synthetic media produced by the Platform
Generated Content is distinct from your original creative work (User Content). Your story, characters, and narrative remain yours. The AI-generated assets that visualize and present your story are Platform outputs subject to the terms below.
6.2 Your Rights in Generated Content
Generated Content created through the Platform may be used freely for:
- •Playing, experiencing, and interacting with stories on the Platform
- •Sharing, streaming, recording, and creating videos featuring Forevle content
- •Commentary, reviews, criticism, educational use, and news coverage
- •Personal archival and sharing
- •Any other use where Forevle content is being featured, discussed, or experienced rather than extracted for separate exploitation
These uses are permitted regardless of whether they are monetized.
The following uses of Generated Content require express written permission from Forevle:
- •Extracting and selling assets — Selling AI-generated images, audio, or other assets as standalone products (prints, stock media, NFTs, asset packs)
- •Use in competing products — Incorporating AI-generated assets into commercial software, games, apps, or other products
- •Licensing to third parties — Granting rights to AI-generated assets to others for their commercial use
- •Bulk extraction — Systematically downloading or scraping Generated Content for use outside the Platform

6.3 The Distinction: Your Story vs. Platform Assets
To be clear about what you can and cannot do:
Your Story (User Content) — You Own This:
- •The narrative you wrote
- •The characters you created
- •The plot, dialogue, and world you designed
- •You can take this anywhere—publish it as a book, adapt it, sell it
Platform Assets (Generated Content) — Licensed for Platform Use:
- •AI-generated images of your characters
- •AI-generated audio and voice
- •AI-generated visual scenes and environments
- •Free for Platform use and personal sharing; commercial external use requires permission
Example: You write a fantasy story on Forevle with a character named "Kira." You can take that story and publish it as a novel elsewhere—Kira is your character, the story is yours. However, you cannot take the AI-generated portrait of Kira that Forevle created and sell it as NFT art or use it in a commercial video game without our permission.
6.4 AI Content Disclaimer
THE GENERATED CONTENT IS CREATED BY ARTIFICIAL INTELLIGENCE SYSTEMS AND IS NOT PRE-REVIEWED, ENDORSED, OR GUARANTEED BY FOREVLE. You acknowledge and agree that:
(a) Generated Content may contain errors, inaccuracies, biases, or content that is incomplete, misleading, offensive, or inappropriate;
(b) Generated Content does not reflect the views, opinions, or endorsements of Forevle;
(c) You should independently verify any information, advice, or guidance contained in Generated Content before relying on it;
(d) Generated Content should not be treated as professional advice (legal, medical, financial, or otherwise);
(e) You use Generated Content at your own risk, and Forevle disclaims all liability for any harm arising from your use of or reliance on Generated Content.
6.5 AI Characters and Fictional Nature
All AI-generated characters, avatars, images, and visual depictions created through the Services are entirely fictional digital creations. You acknowledge and agree that:
(a) All AI-generated characters are depicted as being eighteen (18) years of age or older;
(b) AI-generated characters are not intentional reproductions, representations, or copies of any real person, living or deceased;
(c) Any resemblance between AI-generated characters and real persons is purely coincidental and unintentional;
(d) AI-generated content does not depict real events, real locations, or real circumstances unless explicitly created from User-provided content describing fictional scenarios.
6.6 Prohibition on Real Person Depictions
You are strictly prohibited from using the Services to create content depicting, representing, or resembling any real person without proper authorization. This includes but is not limited to:
(a) Celebrities, public figures, politicians, athletes, and entertainers;
(b) Private individuals, including friends, family members, acquaintances, or strangers;
(c) Historical figures who have been deceased for less than seventy (70) years from the date of death;
(d) Any person whose likeness, name, voice, or persona you do not have explicit authorization to use.
Exceptions: You may create content based on historical figures who have been deceased for seventy (70) years or more. This is a Platform policy threshold, not a legal determination—publicity and personality rights vary by jurisdiction and may extend beyond this period. You remain responsible for compliance with applicable laws in your jurisdiction.
Any attempt to create content depicting real persons without authorization is a serious violation of these Terms and may result in immediate account termination and potential legal action.
6.7 Prohibition on Misrepresenting AI Content
You are strictly prohibited from:
(a) Representing, claiming, or implying that AI-generated content from the Services depicts real people, real events, or real circumstances when sharing such content outside the Platform;
(b) Using AI-generated content to deceive, defraud, or mislead others into believing the content is authentic, real, or factual;
(c) Using AI-generated content for disinformation, fake news, or fraudulent purposes;
(d) Removing, obscuring, or altering any indicators, metadata, or watermarks that identify content as AI-generated.
When sharing AI-generated content outside the Platform, you must clearly disclose that the content was generated by artificial intelligence.
6.8 AI Training Opt-In
Forevle does not use your content to train AI models by default.
We may in the future offer an optional program allowing Users to contribute their content to help improve our AI Systems. If we introduce such a program:
(a) Participation will be entirely voluntary and will require your explicit opt-in consent;
(b) Creators may designate their Stories as excluded from AI training regardless of Player preferences;
(c) Private Stories will never be used for AI training under any circumstances;
(d) You may withdraw your consent at any time, which will apply to future training but may not affect models already trained;
(e) Additional terms and any benefits for participation will be disclosed when such a program is offered.

7. INTELLECTUAL PROPERTY RIGHTS
7.1 Forevle's Intellectual Property
The Services and all Platform Content, including the software, code, algorithms, AI Systems, user interfaces, designs, graphics, logos, trademarks, service marks, trade names, text, images, audio, video, and other materials (collectively, "Forevle IP"), are owned by or licensed to Forevle and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
Subject to your compliance with these Terms, Forevle grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services solely for your personal, non-commercial use (unless you have a valid Creator account and are creating Stories in accordance with these Terms).
7.2 Restrictions
Except as expressly permitted by these Terms, you may not:
(a) Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works of the Services or any Forevle IP;
(b) Rent, lease, loan, sell, sublicense, distribute, or otherwise transfer the Services or any Forevle IP;
(c) Remove, alter, or obscure any copyright, trademark, or other proprietary notices;
(d) Use any robot, spider, scraper, data mining tool, or other automated means to access the Services;
(e) Interfere with, disrupt, or circumvent any security features, access controls, or technical limitations of the Services;
(f) Use the Services or any Forevle IP for any unlawful purpose or in violation of any applicable law;
(g) Extract, download, or scrape Generated Content for the purpose of selling assets, incorporating them into competing commercial products, or licensing them to third parties, without our express written consent;
(h) Attempt to access, probe, or test the vulnerability of the Services or any associated system or network;
(i) Use the Services in any manner that could damage, disable, overburden, or impair the Services.
7.3 Trademarks
"Forevle," the Forevle logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Forevle or its affiliates. You may not use such marks without our prior written permission. All other trademarks, service marks, and trade names appearing on the Services are the property of their respective owners.
7.4 Watermarks and Content Authenticity
The Services display the Forevle logo and branding ("Watermarks") in the header, footer, and other locations throughout the Platform. These Watermarks serve as authenticity markers indicating content originates from or was created using Forevle. Additionally, Generated Content may include metadata or other identifiers.
Permitted Use: You may crop, screenshot, or screen-record content from the Platform for legitimate purposes, provided that:
(a) You do not act in bad faith or with intent to deceive;
(b) You do not deliberately remove or obscure Watermarks that are visible in the original view;
(c) You comply with Section 6.6 (Prohibition on Misrepresenting AI Content);
(d) When Watermarks are visible in the content as displayed on the Platform, they must remain visible when you share that content.
Prohibited Actions: You are strictly prohibited from:
(a) Using technical means to deliberately strip, remove, or alter Watermarks or metadata;
(b) Editing or manipulating content specifically to remove or obscure Watermarks;
(c) Creating tools or software designed to remove Watermarks from Forevle content;
(d) Removing Watermarks in bad faith or for purposes of misrepresentation.
Violation of this provision may result in termination of your Account and may subject you to legal liability.
7.5 Copyright Complaints (DMCA)
Forevle respects the intellectual property rights of others. If you believe that any content on the Services infringes your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our designated Copyright Agent with the following information in writing:
(a) A physical or electronic signature of the copyright owner or authorized agent;
(b) Identification of the copyrighted work claimed to have been infringed;
(c) Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with sufficient information to enable us to locate the material;
(d) Your contact information, including address, telephone number, and email address;
(e) A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
(f) A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
DMCA notices should be sent to:

Counter-Notifications: If you believe your content was removed by mistake or misidentification, you may submit a counter-notification containing:
(a) Your physical or electronic signature;
(b) Identification of the content that was removed and the location where it appeared before removal;
(c) A statement under penalty of perjury that you have a good faith belief that the content was removed due to mistake or misidentification;
(d) Your name, address, telephone number, and email address;
(e) A statement that you consent to the jurisdiction of a court of competent jurisdiction as determined by Forevle, with preference given to courts in the Netherlands, and that you will accept service of process from the person who filed the original DMCA notice.
Repeat Infringers: In accordance with the DMCA and other applicable laws, Forevle has adopted a policy of terminating, in appropriate circumstances, the accounts of Users who are repeat infringers.
7.6 General Content Removal Requests
In addition to copyright complaints, we provide a procedure for individuals to request removal of content that they believe depicts them without consent or otherwise violates their rights:
(a) Submission: Submit a removal request to [email protected] or through the reporting mechanism in the Services. Your request should include: - Identification of the content you wish to have removed (URL or description); - Explanation of why you believe the content should be removed; - Your contact information; - A statement that the information in your request is accurate.
(b) Review: We will review all removal requests and make a determination based on these Terms, applicable law, and the circumstances presented. Standard requests will be reviewed within fourteen (14) days. Urgent requests involving safety concerns will receive expedited review.
(c) Action: If we determine that removal is warranted, we will remove or disable access to the content within a reasonable timeframe following our determination.
(d) Appeals: Content creators whose content is removed may submit an appeal through the process described in Section 8.6.
8. PROHIBITED CONDUCT AND CONTENT MODERATION
8.1 Creator Guidelines
You agree to comply with our Creator Guidelines, which are incorporated herein by reference and available at forevle.com/guidelines. The Creator Guidelines may be updated from time to time.
8.2 Prohibited Content
You agree not to submit, upload, post, or transmit any User Content, or use the Services in any manner, that:
(a) Illegal Content: - Violates any applicable law, regulation, or legal requirement; - Promotes, facilitates, or encourages illegal activity;
(b) Rights Violations: - Infringes any copyright, trademark, patent, trade secret, or other intellectual property right; - Contains content you do not have the legal right to use, share, or distribute; - Misappropriates any right of publicity, privacy, or personality; - Uses the name, likeness, voice, or persona of any person without proper authorization; - Depicts, represents, or is intended to resemble any real person (living or deceased for less than seventy (70) years from the date of death) without explicit authorization. For purposes of this provision, public domain status shall be determined under the laws of the Netherlands or the laws of the jurisdiction where the depicted person resided at time of death, whichever provides the longer protection period;
(c) Child Safety: - Depicts, promotes, or requests any form of abuse, exploitation, or inappropriate involvement of minors; - Presents individuals who are or appear to be under 18 in adult, suggestive, or exploitative contexts, including through AI-generated material; - Enables manipulation, coercion, or exploitation of minors in any form; - Violations result in immediate permanent termination and may be referred to appropriate authorities when required.
(d) Misrepresentation of AI Content: - Removes, alters, or obscures watermarks or authenticity markers on Generated Content; - Represents AI-generated content as real, authentic, or factual when sharing outside the Platform; - Uses Generated Content for disinformation, fraud, or deception;
(e) Platform Integrity: - Interferes with or disrupts the Services, servers, or networks; - Circumvents any access controls, security measures, or technical limitations; - Involves unauthorized automated access (bots, scrapers, etc.); - Attempts to extract, reverse engineer, or deduce the underlying systems of our AI.
All content on the Platform may contain mature themes and is subject to content warnings. Content Rating System: Forevle automatically assigns initial content ratings to all Stories using automated systems. Creators are obligated to review these ratings and, if necessary, increase them to accurately reflect the content. Creators may always increase a content rating but may not decrease it without contacting support. If a Creator believes an automated rating is too high, they may submit a request to support for review. It is the sole obligation of the Creator to ensure their content does not violate any applicable laws or exceed the limits of their assigned content rating. Mis-rated content may be removed or re-rated at Forevle's discretion.
For detailed guidance on acceptable content and content standards, please refer to our Creator Guidelines, which are incorporated herein by reference.
8.3 Prohibited Conduct
In addition to the content restrictions above, you agree not to:
(a) Use the Services if you are under the applicable minimum age;
(b) Create multiple accounts to evade bans, restrictions, or limitations;
(c) Transfer, sell, or share your account or any virtual currency;
(d) Use the Services to conduct any commercial activity not expressly permitted;
(e) Engage in any activity that could harm minors;
(f) Use the AI Systems to generate content that violates these Terms;
(g) Attempt to extract, reverse engineer, or deduce the underlying prompts, weights, training data, or methodologies of the AI Systems;
(h) Use the Services to develop competing products or services;
(i) Assist or enable any third party to do any of the foregoing.
8.4 Content Moderation
Forevle uses a combination of automated systems (including AI-based moderation) and human review to detect and address content that violates these Terms, our Creator Guidelines, or applicable law. Our content moderation measures include:
(a) Automated Detection: AI systems that scan content for policy violations, including but not limited to prohibited content categories, potential depictions of minors, and attempts to generate content depicting real persons;
(b) Human Review: Manual review by trained moderators for complex cases, appeals, and content flagged by automated systems;
(c) User Reports: A mechanism for Users to report potentially violating content through the Services;
(d) Pre-Publication Review: Certain content categories or high-risk content may be subject to review before publication;
(e) Quality Curation: Systems that evaluate and promote high-quality content based on engagement and retention metrics.
Transparency: We are committed to transparency in our content moderation practices. While our systems are designed to detect and prevent violations, no automated system is 100% accurate. We continuously work to improve our detection capabilities and reduce both false positives and false negatives. Users remain responsible for ensuring their content complies with these Terms and our Creator Guidelines, regardless of whether our systems flag specific content.
8.5 Enforcement Actions
If we determine that you have violated these Terms, we may take any of the following actions, in our sole discretion:
(a) Issue a warning;
(b) Remove, disable, or restrict access to violating content;
(c) Restrict your access to certain features;
(d) Temporarily suspend your Account;
(e) Permanently terminate your Account;
(f) Report the violation to law enforcement or other authorities;
(g) Pursue legal action.
The severity of the enforcement action will generally be proportionate to the nature and severity of the violation, your violation history, and other relevant factors. However, we reserve the right to take any enforcement action we deem appropriate in any given circumstance.
8.6 Appeals
If you believe your content was removed or your account was actioned in error, you may submit an appeal through the mechanism provided in the Services. We will review your appeal and notify you of our decision. For European Users, additional appeal rights may apply as described in Section 15.
9. SUBSCRIPTION PLANS, PAYMENTS, AND VIRTUAL CURRENCY
9.1 Free and Paid Services
Forevle offers both free and paid tiers of service:
(a) Free Tier: Access to selected content and features as determined by Forevle. Free tier may be ad-supported.
(b) Paid Subscriptions: Access to premium features, enhanced AI capabilities, and additional benefits as described on our pricing page.
(c) Additional Purchases: One-time purchases of virtual credits or other items as offered on the Platform.
Specific features, pricing, and benefits for each tier are displayed on the Services and may change from time to time.
9.2 Subscription Terms
By purchasing a Subscription:
(a) You authorize us (or our payment processor) to charge the applicable fee to your designated payment method on a recurring basis (monthly, annually, or as specified);
(b) Your Subscription will automatically renew at the end of each billing period unless you cancel before the renewal date;
(c) You are responsible for all applicable taxes;
(d) We may change Subscription prices with at least thirty (30) days' notice; price changes will take effect at the start of your next billing period;
(e) If your payment method fails, we may suspend or terminate your access to paid features.
9.3 Virtual Credits
Forevle may offer virtual credits or currency ("Credits") that can be used to access certain features or content on the Platform.
(a) No Real-World Value: Credits have no real-world monetary value and cannot be exchanged for cash or other consideration;
(b) License Only: Purchase of Credits constitutes a license to use such Credits within the Services, not ownership;
(c) Non-Refundable: Credits are non-refundable except as required by applicable law;
(d) Non-Transferable: Credits may not be sold, traded, gifted, or transferred to other Users;
(e) Expiration: Credits may expire if not used within a specified period, as disclosed at the time of purchase;
(f) Modification: We reserve the right to modify the pricing, availability, or functionality of Credits at any time.
9.4 Cancellation and Refunds
(a) Cancellation: You may cancel your Subscription at any time through your account settings or by contacting support. Cancellation will be effective at the end of your current billing period, and you will continue to have access to paid features until that time.
(b) Digital Goods – No Statutory Right to Refund: The Services constitute digital content and digital goods that are made accessible immediately upon purchase. By completing a purchase and accessing the Services, you expressly acknowledge and agree that:
(i) The digital content is made available to you immediately upon purchase;
(ii) You expressly consent to immediate performance and access;
(iii) You acknowledge that you lose your statutory right of withdrawal (including any 14-day cooling-off period under EU consumer law) once the digital content has been accessed or the service performance has begun;
(iv) Under applicable law, including Directive 2011/83/EU (Consumer Rights Directive) and equivalent national implementations, digital content not supplied on a tangible medium is exempt from refund rights once accessed with prior express consent.
Accordingly, you lose your statutory right of withdrawal once digital content has been accessed with your prior express consent.
This does not affect any statutory remedies you may have if the digital content does not conform to the contract (see Section 15.4 for European Users).
(c) Discretionary Refunds – Our Good Faith Policy: Notwithstanding the above, Forevle acts in good faith and may, in our sole and absolute discretion, consider refund requests on a case-by-case basis. We are not legally obligated to provide any refund, but we may choose to do so in circumstances such as:
- •Technical errors resulting in incorrect charges;
- •Inadvertent subscription renewals where the User did not actively use the Services;
- •Promises or commitments made by Forevle support;
- •Other circumstances we deem appropriate.
To request a discretionary refund, contact [email protected] with details of your situation. We may grant refunds even after typical refund periods have passed, at our discretion. This good faith policy shall not be construed as creating any legal right to a refund and shall not be abused by bad actors who use the Services and then seek refunds.
(d) App Store Purchases: If you purchased a Subscription through the Apple App Store or Google Play Store, refunds are subject to the policies of those platforms. You must request refunds directly from Apple or Google, and Forevle has no ability to process refunds for such purchases.
(e) Credits: Purchased Credits are non-refundable under any circumstances, except where required by applicable law that cannot be waived.
9.5 Price Changes
We may modify our pricing at any time. For existing subscribers, we will provide at least thirty (30) days' notice before any price increase takes effect. The new price will apply to your next billing cycle following the notice period. If you do not agree to the new price, you may cancel your Subscription before the new price takes effect.
9.6 Billing Disputes
If you believe you have been incorrectly charged, you must contact us within sixty (60) days of the charge. Failure to notify us within this period may result in waiver of any claim related to the charge (except where prohibited by law).
9.7 Creator Monetization
Forevle may offer programs that allow Creators to earn revenue from their content on the Platform ("Creator Monetization Programs"). Participation in any Creator Monetization Program is subject to additional terms and eligibility requirements that will be made available when such programs are launched. Forevle reserves the right to modify, suspend, or terminate any Creator Monetization Program at any time.
10. DISCLAIMERS AND LIMITATION OF LIABILITY
10.1 Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES, PLATFORM CONTENT, GENERATED CONTENT, AND ALL MATERIALS, INFORMATION, AND SERVICES PROVIDED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
FOREVLE AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
(a) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT;
(b) WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE;
(c) WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
(d) WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT, INCLUDING GENERATED CONTENT;
(e) WARRANTIES THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS;
(f) WARRANTIES REGARDING THE QUALITY, ORIGINALITY, OR NON-INFRINGEMENT OF ANY GENERATED CONTENT.
YOU ACKNOWLEDGE THAT AI-GENERATED CONTENT MAY CONTAIN ERRORS, BIASES, INACCURACIES, OR OBJECTIONABLE MATERIAL, AND YOU USE SUCH CONTENT AT YOUR OWN RISK.
10.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
(a) IN NO EVENT SHALL FOREVLE, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR REPRESENTATIVES (COLLECTIVELY, THE "FOREVLE PARTIES") BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WHETHER ANY FOREVLE PARTY WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
(b) IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE FOREVLE PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS EXCEED THE GREATER OF: (i) THE AMOUNT YOU PAID TO FOREVLE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (ii) ONE HUNDRED U.S. DOLLARS ($100 USD).
(c) THE FOREGOING LIMITATIONS APPLY TO ALL CLAIMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.
(d) THE FOREVLE PARTIES SHALL NOT BE LIABLE FOR ANY ACTS OR OMISSIONS OF THIRD PARTIES, INCLUDING OTHER USERS, PAYMENT PROCESSORS, OR HOSTING PROVIDERS.
10.3 Specific Disclaimers
WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, THE FOREVLE PARTIES SHALL NOT BE LIABLE FOR:
(a) Any harm resulting from User Content or Generated Content, including content that is inaccurate, offensive, infringing, or otherwise objectionable;
(b) Any harm arising from your interactions with other Users;
(c) Any decisions you make based on Content available through the Services;
(d) Any technical malfunctions, system failures, or service interruptions;
(e) Any loss of data, User Content, or account information;
(f) Any unauthorized access to or use of your Account;
(g) Any conduct of third parties on or through the Services.
10.4 Exceptions
Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, Forevle's liability shall be limited to the maximum extent permitted by applicable law.
If you are a consumer in the EEA, UK, or other jurisdiction with mandatory consumer protection laws, these disclaimers and limitations apply only to the extent permitted by applicable law, and do not affect any non-waivable statutory rights you may have.
10.5 EEA Users – Mandatory Liability
For users who are consumers in the EEA: The disclaimers and limitations in this Section 10 do not apply to: (a) liability for death or personal injury caused by our negligence; (b) liability for fraud or fraudulent misrepresentation; (c) liability for gross negligence or willful misconduct; (d) any other liability that cannot be excluded or limited under mandatory EU or national law.
11. INDEMNIFICATION
11.1 Your Indemnification Obligations
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Forevle Parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and costs) arising out of or relating to:
(a) Your access to or use of the Services;
(b) Your User Content or any use thereof;
(c) Your violation of these Terms, any applicable law, or any third-party right (including intellectual property rights, privacy rights, and publicity rights);
(d) Your interactions with other Users;
(e) Any dispute between you and a third party arising from your use of the Services;
(f) Your negligence or willful misconduct.
11.2 Procedure
We will promptly notify you of any claim subject to indemnification and will provide reasonable assistance at your expense in defending the claim. We reserve the right, at your expense, to assume the exclusive defense and control of any claim subject to indemnification, and you agree to cooperate with our defense. You may not settle any claim without our prior written consent.
11.3 Consumer Exceptions
If you are a consumer in the EEA or UK, this indemnification provision applies only to the extent that the claims arise from your breach of these Terms, your User Content, or your tortious or illegal conduct, and only to the extent permitted by applicable law.
12. DISPUTE RESOLUTION AND ARBITRATION
12.1 Informal Resolution First
Before initiating any formal dispute resolution proceeding, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least thirty (30) days. Most disputes can be resolved through good-faith negotiation.
12.2 Binding Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
You and Forevle agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or your relationship with Forevle (collectively, "Disputes") will be resolved through binding individual arbitration, rather than in court, except that:
(a) Either party may bring individual claims in small claims court if the claims qualify;
(b) Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent infringement or misappropriation of intellectual property rights;
(c) This arbitration agreement does not apply to Users who are consumers habitually resident in the EEA, UK, or Switzerland (see Section 15 for European Users).
By agreeing to these Terms, you and Forevle are each waiving the right to a trial by jury and the right to participate in a class action, class arbitration, or representative action (where permitted by law).
12.3 Arbitration Rules and Procedures
Any arbitration will be administered by the International Chamber of Commerce ("ICC") pursuant to its Arbitration Rules (the "ICC Rules"). The ICC Rules are available at www.iccwbo.org.
(a) Arbitrator Selection: The arbitration will be conducted by a single arbitrator selected in accordance with the ICC Rules.
(b) Location: The seat of arbitration shall be Amsterdam, the Netherlands. Hearings may be conducted remotely by video conference.
(c) Language: The arbitration shall be conducted in English.
(d) Fees: Arbitration fees will be allocated as specified in the ICC Rules. For claims under €10,000, Forevle will pay all arbitration fees if you prevail. Regardless of the outcome, Forevle will not seek attorneys' fees or arbitration costs from you unless the arbitrator determines your claim was frivolous.
(e) Confidentiality: The arbitration proceedings, including any discovery, documents, testimony, or other evidence, shall be kept confidential.
(f) Award: The arbitrator's decision and award will be final and binding. Judgment on the award may be entered in any court of competent jurisdiction.
12.4 Class Action Waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND FOREVLE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR CONSOLIDATED ACTION OR PROCEEDING.
UNLESS BOTH YOU AND FOREVLE AGREE OTHERWISE IN WRITING, THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN MORE THAN ONE PARTY'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
12.5 Opt-Out
You may opt out of this arbitration agreement by sending written notice to [email protected] within thirty (30) days of first accepting these Terms. Your notice must include your name, address, email address, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in accordance with Section 13.
12.6 Survival
This arbitration agreement shall survive termination of these Terms and your use of the Services.
12.7 Claims Time Limitation
TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER THE CLAIM ACCRUES, OR SUCH CLAIM IS PERMANENTLY BARRED.
13. GOVERNING LAW AND JURISDICTION
13.1 Governing Law
These Terms and all Disputes shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of laws principles.
13.2 Jurisdiction and Venue (Non-European Users)
For any claims not subject to arbitration, you and Forevle consent to the exclusive jurisdiction and venue of the courts of Amsterdam, the Netherlands. You waive any objection to such jurisdiction or venue.
13.3 Governing Law and Jurisdiction (European Users)
For Users who are consumers in the EEA, UK, or Switzerland:
(a) These Terms shall be governed by the law of your country of habitual residence;
(b) You may bring claims against Forevle in the courts of your country of habitual residence or in the courts of the Netherlands (where Forevle B.V. is established);
(c) Forevle may bring claims against you only in the courts of your country of habitual residence;
(d) Nothing in these Terms limits your rights under mandatory consumer protection laws in your jurisdiction;
(e) You may be entitled to use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
14. TERMINATION
14.1 Termination by You
You may terminate your Account at any time by following the instructions in the Services or by contacting [email protected]. Upon termination, your right to access and use the Services will immediately cease.
14.2 Termination by Forevle
We may suspend or terminate your Account and access to the Services at any time, with or without cause, with or without notice. Reasons for termination may include, but are not limited to:
(a) Violation of these Terms or our Creator Guidelines;
(b) Conduct that harms or threatens to harm other Users, Forevle, or third parties;
(c) Conduct that creates legal liability or regulatory risk;
(d) Extended periods of inactivity;
(e) Request by law enforcement or government authorities;
(f) Technical or security issues;
(g) Discontinuation of the Services.
14.3 Effect of Termination
Upon termination of your Account:
(a) All rights and licenses granted to you under these Terms will immediately terminate;
(b) You must immediately cease all use of the Services;
(c) We may (but are not obligated to) delete your Account information and User Content;
(d) Any unused virtual currency or Subscription benefits will be forfeited without refund (except as required by law);
(e) We may retain certain information as required by law or for legitimate business purposes;
(f) Sections of these Terms that by their nature should survive termination (including Sections 5-7, 10-13, and 17) shall survive.
14.4 European Users – Termination Notice
If you are a consumer in the EEA, UK, or Switzerland, we will provide reasonable notice before terminating your Account for cause (except in cases of severe violations requiring immediate action) and an opportunity to address the issue where practicable. You will receive an explanation of the reasons for termination.
15. EUROPEAN UNION USERS – ADDITIONAL RIGHTS
15.1 Applicability
This Section 15 applies to Users who are consumers habitually resident in the EEA, UK, or Switzerland ("European Users"). The provisions in this Section supplement (and where inconsistent, supersede) the provisions elsewhere in these Terms for European Users.
15.2 Consumer Rights
As a European User, you have certain non-waivable rights under applicable consumer protection laws, including but not limited to:
(a) The right to receive services as described and of satisfactory quality;
(b) Protection against unfair contract terms;
(c) The right to receive clear and comprehensible information about the Services, including pricing;
(d) The right to bring legal proceedings in the courts of your country of habitual residence.
Nothing in these Terms limits or waives these rights.
15.3 Right of Withdrawal – Digital Content Exception
Under EU consumer law (Directive 2011/83/EU), consumers normally have a 14-day right to withdraw from online purchases. However, this right does not apply to digital content not supplied on a tangible medium once performance has begun with your prior express consent and acknowledgment that you lose your right of withdrawal.
When you make a purchase on Forevle:
(a) You will be asked to expressly consent to immediate access to the digital content;
(b) You will acknowledge that by consenting to immediate access, you lose your right of withdrawal;
(c) Upon providing this consent and completing your purchase, your statutory withdrawal right is waived.
This is not a limitation imposed by Forevle—it is the legal framework established by EU consumer protection law for digital content. Forevle complies with all requirements for obtaining this consent and acknowledgment during the purchase process.
Notwithstanding the above, Forevle may, in its sole discretion, consider refund requests as described in Section 9.4(c). This discretionary policy does not create any legal right to a refund.
15.4 Statutory Warranty (Conformity)
As a European consumer, you have a statutory right to services that conform to the contract and are free from defects. If the Services do not conform to the contract, you may be entitled to remedies under applicable law, including having the Services brought into conformity, receiving a proportionate reduction in price, or terminating the contract.
15.5 Dispute Resolution
(a) European Users are not bound by the arbitration provisions in Section 12.
(b) Governing Law: These Terms shall be governed by the law of your country of habitual residence.
(c) Jurisdiction: You may bring claims in the courts of your habitual residence or the courts of the Netherlands. Forevle may bring claims only in the courts of your habitual residence.
(d) Mediation: Before initiating court proceedings, we encourage you to contact us to attempt to resolve any dispute informally. You may also request mediation through a certified mediation body in your country of residence. Mediation is typically faster and less expensive than court proceedings.
(e) Alternative Dispute Resolution: You may be entitled to refer disputes to an out-of-court dispute settlement body (certified under Article 21 of the Digital Services Act) or use the European Commission's Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr. Forevle commits to engaging in good faith with certified out-of-court dispute settlement procedures.
15.6 Transparency and Explanations
Where required by the Digital Services Act (DSA) or other applicable law, we will provide you with:
(a) Clear explanations of any content moderation decisions affecting your Account or content;
(b) Information about the reasons for any restrictions placed on your Account;
(c) Information about available redress mechanisms, including internal complaint-handling and out-of-court dispute settlement;
(d) A plain-language summary of these Terms.
15.7 Data Protection
Your personal data is processed in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR). You have rights under the GDPR, including rights of access, rectification, erasure, restriction, objection, and data portability. For more information, please see our Privacy Policy.
16. DIGITAL SERVICES ACT COMPLIANCE
16.1 Scope
This Section 16 sets out additional information and obligations pursuant to Regulation (EU) 2022/2065 (the Digital Services Act or "DSA"). These provisions apply to users located in the EU.

(e) Notice and Action: We process notices of illegal content in accordance with Article 16 of the DSA.
16.5 Notice and Action Mechanism
To report content you believe is illegal under EU law, use the reporting mechanism in the Services or submit a notice to: [email protected]. Your notice should include:
(a) An explanation of why you consider the content to be illegal;
(b) A clear indication of the location of the content (e.g., URL);
(c) Your name and email address;
(d) A statement that you believe in good faith that the information is accurate.
We will acknowledge receipt promptly, investigate, and inform you of our decision and the reasons for it.
16.6 Statement of Reasons
When we remove or restrict access to content, or suspend or terminate an account, we will provide a statement of reasons to the affected user, including:
(a) The facts and circumstances relied upon;
(b) The legal or contractual basis for the decision;
(c) Information about automated tools used in the decision (if applicable);
(d) Information about redress possibilities, including internal complaint mechanisms and out-of-court dispute settlement.
16.7 Internal Complaint-Handling
European Users may lodge a complaint against content moderation decisions through our internal complaint-handling mechanism. To file a complaint:
(a) Submit your complaint through the appeals mechanism in the Services or via [email protected];
(b) Include the details of the decision you are disputing and the reasons you believe it was incorrect;
(c) We will review your complaint and notify you of our decision within a reasonable timeframe.
16.8 Out-of-Court Dispute Settlement
European Users may seek resolution of disputes relating to content moderation decisions through a certified out-of-court dispute settlement body under Article 21 of the DSA. Information about certified bodies is available from your national Digital Services Coordinator. Forevle will engage in good faith with any such proceedings.
16.9 Trusted Flaggers
We may designate certain entities as trusted flaggers whose reports of potentially illegal content will receive priority processing in accordance with Article 22 of the DSA.
16.10 Protection of Minors
We take measures to protect minors on the Platform, including:
(a) Age verification/assurance mechanisms;
(b) Prohibition of targeted advertising based on profiling of minors;
(c) Content ratings and age-gating for mature content;
(d) Default privacy-protective settings for users identified as minors.
16.11 Transparency Reporting
In accordance with DSA requirements, we will publish transparency reports containing information about our content moderation activities, including complaint statistics and information about any orders received from authorities.
16.12 Recommender Systems
Our Platform uses algorithmic recommender systems to suggest and surface content. These systems consider factors including:
(a) User engagement metrics (play time, completion rate, retention);
(b) User preferences and history;
(c) Content quality signals;
(d) Recency.
European Users may access non-personalized alternatives to our default recommender systems through account settings.
16.13 Advertising Transparency
If we display advertising on the Platform, we will:
(a) Clearly label advertisements;
(b) Provide information about who is placing the advertisement and on whose behalf;
(c) Provide meaningful information about the parameters used to target the advertisement;
(d) Not target advertisements based on profiling using special categories of personal data (as defined in GDPR Article 9);
(e) Not target advertisements to users we know to be minors.
17. MISCELLANEOUS PROVISIONS
17.1 Entire Agreement
These Terms, together with the Privacy Policy, Creator Guidelines, and any Additional Terms, constitute the entire agreement between you and Forevle regarding the Services and supersede all prior or contemporaneous agreements, understandings, representations, and warranties, whether written or oral.
17.2 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its intent. If such modification is not possible, the provision shall be severed, and the remaining provisions shall continue in full force and effect.
17.3 Waiver
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
17.4 Assignment
You may not assign, transfer, or delegate these Terms or any of your rights or obligations hereunder without our prior written consent. We may assign, transfer, or delegate these Terms and our rights and obligations without restriction. Subject to the foregoing, these Terms shall bind and inure to the benefit of the parties, their successors, and permitted assigns.
17.5 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights except as expressly provided herein or as required by applicable law.
17.6 Force Majeure
Forevle shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, epidemics, pandemics, strikes, or failures of third-party utilities, telecommunications, or Internet service providers.
17.7 Notices
All notices to Forevle shall be sent to: [email protected] or to our physical address. Notices to you may be sent to the email address associated with your Account. Notices are deemed effective upon receipt.
17.8 Headings
Section headings are for convenience only and do not affect the interpretation of these Terms.
17.9 Relationship of Parties
Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between you and Forevle.
17.10 California Residents
If you are a California resident, in accordance with Cal. Civ. 17.11 Sanctions and Export Compliance
You agree to comply with all applicable sanctions, export control, and trade laws and regulations, including those of the European Union, the Netherlands, the United States, and any other applicable jurisdiction. You may not use the Services if you are located in a comprehensively sanctioned jurisdiction or are a prohibited party.
17.12 Language
These Terms are drafted in English. If these Terms are translated into any other language and there is a conflict between the English version and the translated version, the English version shall prevail (except where prohibited by local law for European Users).
17.13 Beta and Experimental Features
We may offer certain features, services, or functionalities that are designated as "beta," "preview," "experimental," or similar ("Beta Features"). Beta Features are provided "as is" and "as available" without any warranties. We may modify, suspend, or discontinue Beta Features at any time without notice. Your use of Beta Features is at your own risk, and we shall have no liability for any harm arising from your use of Beta Features.
17.14 User Interactions
You are solely responsible for your interactions with other Users. Forevle is not responsible for the conduct of any User on or off the Services. We reserve the right, but have no obligation, to monitor or become involved in disputes between Users. If you have a dispute with another User, you release Forevle from all claims, demands, and damages arising out of or relating to such dispute.
If we introduce features that enable User-to-User communication (such as comments, messages, or forums), you agree to use such features respectfully and in compliance with these Terms. Harassment, bullying, threats, or abusive behavior toward other Users is strictly prohibited and may result in account termination.
17.15 Data Retention After Account Deletion
If you delete your Account, we will retain your data for ninety (90) days to allow for account recovery or to address any pending issues. After this period, your personal data will be deleted, except that:
(a) We may retain data as required by applicable law or legal process;
(b) We may retain data necessary to enforce these Terms or protect our legal rights;
(c) Backup copies may persist for a reasonable period as part of normal backup procedures;
(d) Published content that has been played by other users or incorporated into shared experiences may remain on the Platform with your personal identifiers removed (attributed to "Deleted User"). If you require complete removal of specific published content, contact [email protected].

17.16 Interpretation
(a) Headings and Formatting: Section headings, formatting, bold text, and visual presentation are for convenience only and do not affect the interpretation or construction of these Terms.
(b) Cross-References: Any reference to a specific section, clause, or provision that is incorrect, outdated, or does not exist shall be interpreted as a reference to the section, clause, or provision that most closely addresses the relevant subject matter. Incorrect cross-references do not invalidate the underlying obligation or right.
(c) Internal Conflicts: If any provisions of these Terms conflict with each other, the following order of priority applies: (i) provisions required by applicable law take precedence; (ii) more specific provisions take precedence over general provisions; (iii) provisions that appear later in the document take precedence over earlier provisions, unless the earlier provision expressly states otherwise.
(d) Conflicts with Other Documents: In the event of a conflict between these Terms and any Additional Terms, the Additional Terms shall control with respect to the specific feature or service to which they apply. In the event of a conflict between these Terms and the Privacy Policy, Creator Guidelines, or AI Disclosure, these Terms shall control unless the conflicting provision relates to data protection (in which case the Privacy Policy controls) or content standards (in which case the Creator Guidelines control).
(e) Lists and Examples: The words "include," "includes," and "including" are deemed to be followed by "without limitation." Lists of examples are illustrative and not exhaustive unless expressly stated otherwise.
(f) Singular and Plural: Words in the singular include the plural and vice versa, unless the context requires otherwise.
(g) Currency: All monetary amounts are in United States Dollars (USD) unless otherwise specified.
(h) Time Periods: Unless otherwise specified, references to "days" mean calendar days. If a deadline falls on a weekend or public holiday in the Netherlands, the deadline extends to the next business day.
17.17 Drafting
These Terms shall not be construed against Forevle merely because Forevle drafted them. Both parties acknowledge the opportunity to review these Terms and seek independent legal advice.
17.18 Errors and Corrections
Forevle reserves the right to correct any errors, inaccuracies, or omissions in these Terms, including incorrect cross-references, typographical errors, or outdated information, at any time without prior notice. Such corrections do not constitute material changes requiring the notice period described in Section 1.3, provided they do not materially affect your rights or obligations.
